04 · Platform Donation Terms — Flow 2

Terms for donations that build the platform. Irrevocable charitable gifts, no financial rights. Distinct from Flow 3 (Future Waqf Donations, doc 04b) and from Flow 1 (SAFE, doc 01). EU consumer law applies. Draft for Bulgarian/EU consumer counsel. Not legal advice.

1. Who receives your donation

EVA DAVA EOOD, VAT BG207945177, Burgas, Bulgaria ("we"), acting as temporary administrator of the digiwaqf project. Contact: ceo@evadava.com.

2. What this donation is

2.1 A donation (sadaqah) to build the digiwaqf platform. It is not an investment, not a loan, not a purchase of securities, and not a deposit.

2.2 It funds: MVP and platform development, legal work and incorporation, design, development, marketing, and pre-launch operations.

2.3 It is irrevocable and non-refundable. If the project ultimately fails, the donation is not refunded — exactly as with charity. You should donate only what you are prepared to give away entirely.

3. What you do NOT receive

No equity, no shares, no profit, no dividend, no interest, no revenue share, no repayment, no ownership of any kind — in EVA DAVA, in U21C, or in any Waqf.

4. What you MAY receive (non-financial)

Recognition and community standing only, at our discretion:

• Status tiers — Silver, Gold, Diamond (thresholds published on the platform)
• Badges and recognition (e.g. Founders' Wall)
• Community access and build updates
• Voting points — see §5

These are non-financial, non-transferable, revocable benefits with no monetary value and no redemption right.

5. Voting is advisory only

Voting points let you signal which vetted startups you favour. Voting is advisory and not binding. Final funding decisions rest with the Sharia Investment Committee. Points confer no ownership or economic right.

6. Segregation and transparency

Donations are held on a segregated, separately-accounted basis (doc 03) and applied only to the stated purpose. We publish aggregate progress, milestones and use of funds (no personal data).

7. Not the Waqf

This donation builds the platform. It is not a contribution to Waqf capital. If you wish to seed the future Waqf, that is a separate flow with separate terms (doc 04b), available once the Waqf can lawfully be established.

8. Shariah status

The project is pre-launch: not yet a licensed Waqf and not Shariah-certified. The sadaqah-jariyah characterisation is under review by the Shariah Supervisory Board (Mufti Ismail Desai). Nothing here is a Shariah ruling.

9. Your data

Processed per the Privacy Policy (GDPR). Payments are processed by Stripe; we do not store card details.

10. Governing law & disputes

Per doc 00 Part B: laws of Bulgaria and mandatory EU law; your mandatory consumer rights are unaffected; competent Bulgarian courts, and an EU-resident consumer may sue in (and may only be sued in) their place of domicile. Optional mediation. No arbitration is imposed on consumers.

11. Changes

We may update these Terms prospectively; the version in force at the time of your donation governs it. Version: [pre-launch v1, date].
